II. About Office Max
Office Max is an e-commerce service that offers its users the opportunity to take possession of the displayed products. Products are purchased based on orders received through the website or by phone.

III. Intellectual Property
The content and design of Office Max, as well as any other material related to it sent by you by email or provided by you in any other way (example: articles, design, product description and any other materials), belong to the Company and/or its collaborators - where this is expressly specified - (copyright) and are protected by intellectual property legislation. You may not use, reproduce or allow anyone to use or reproduce the Office Max materials without prior written permission from the Company.
You may not use frames (frames in the sense of the HTML language) or framing techniques (framing techniques in the sense of the HTML language) for brands, logos, or other information protected by copyright law (including images, texts, interfaces, forms) of Office Max without having a prior written permission from the Company.
The limited, revocable and non-exclusive creation of hyperlinks to the Office Max index page is permitted, as long as this action does not present the Office Max service in a false, misleading, derogatory or offensive light. You may not use the company logo or other graphic properties or brands as part of hyperlinks without prior written permission from the Company.

IV. User registration
The Office Max website can be accessed for free, and simply browsing its pages is not conditioned by user registration (creating a user account on the Website). However, in order to benefit from certain services offered by the Site, such as purchasing the products offered by it, receiving the Office Max newsletter or checking the status of your own orders, you will need to register as a user (create a user account on the Site). Registering as a user requires your prior acceptance of the Terms and Conditions of use of Office Max and its Privacy Policy. These regulations constitute the contractual basis of the relations between users and the Company.
Since the provisions of the Terms and Conditions of Use and the Privacy Policy can be modified, please review them periodically. If you no longer agree with their provisions, please stop accessing/using the Office Max services.
If you use this Site, you are responsible for maintaining the confidentiality of the access data in your user account, created on the Site, and you agree to assume responsibility for all activities performed from your user account, created on the Site.
Office Max can sell products for children under 14 (fourteen) years of age, but sells them to adults, who are authorized to make online payments by card or by any other payment method accepted by Office Max. If you are under 14 (fourteen) years old, you can purchase Office Max products, only with the help of a parent or guardian.
Office Max reserves the right to close user accounts, to modify or remove texts, images, hyperlinks, or to refuse the sale of products, at its own discretion.

V. Personal Data
By registering as a user of Office Max, we will ask you for a series of personal data, such as your name and surname, email address, phone, but also other personal information, which will allow the delivery of products and your identification as a user of the Office Max service. Also, in order to subscribe to the Office Max newsletter or alerts, you will need to provide us with a valid e-mail address as well as other data related to you. Please access the page where the Privacy Policy is presented to inform you regarding the information collected by Office Max, regarding how it is used, as well as the rights regarding the protection of your privacy.

VI. Purchase procedure
To buy and take possession of the products offered for sale on Office Max, it is necessary to go through the following steps:
- product identification and selection
- your registration as a user of Office Max
- paying for the products. Payment is made by online card or by bank transfer/payment order, under the conditions regulated in Chapter VII, and the final cost will include the price of the ordered product including VAT, the delivery price and, if applicable, the price of the green stamp, in accordance with the provisions HG448/2005.
- the delivery of the products ordered and paid for will be accompanied, if necessary, by the warranty certificate, the certificate regarding the after-sales service provided by the manufacturer/importer/distributor and/or other certificates if necessary.
By placing an electronic or telephone order on Office Max, you agree to the form of communication (telephone or e-mail) through which the Site conducts its operations.

VII. How do I buy?

VII.1. Pricing
With the exception of cases where it is provided otherwise, the prices of the products displayed on Office Max represent the final purchase prices and include VAT (value added tax of 19%, valid in Romania). The final purchase prices can be prices suggested by manufacturers or suppliers, or they can be estimated according to the standard prices practicable at the industry level of the marketed product. The final purchase prices may not represent the most competitive prices on a certain product segment or for a certain period.

VII.2. Payment methods
To pay for the ordered products, you can choose from the following payment methods: bank transfer/payment order or online card. If you chose bank transfer/payment order as the payment method, the following screen thanks you for the order placed and provides you with the relevant information for the order and payment. You will also receive this information by e-mail, in the form of an order confirmation.

 

VII.2.1. How do I buy and pay for products on the Office Max website by bank transfer/payment order?
You can buy products through Office Max following 3 steps:
a. Select the product you want to purchase and click on the "Order now" link.
b. Enter/confirm your personal data.
This information is necessary for the correct and efficient processing of the order placed by you. Please fill out the form correctly and indicate the persons to whom the invoicing and delivery are made. The e-mail address is extremely important because the information related to the order and the ordered products will be sent by e-mail. An incorrect email address slows down the entire ordering process. Moreover, the Company will not be able to contact you and inform you about the status of your order. If the delivery address is not the same as the billing address, indicate this by unchecking the option. The delivery address is the same as the billing address at the end of the form. Choose the desired payment method and confirm the data by choosing "Next Step". If the delivery address, or the billing address, or both addresses are not the same as the addresses you have registered in your user account on the Site, before proceeding to the next step in the process of placing the order, enter the billing addresses and/ or delivery valid for the respective order. If you have chosen the payment method Bank transfer/payment order, you will receive by e-mail an order confirmation with all the data regarding your order, the next step being making the payment as soon as possible. In the process of making the payment by bank transfer/payment order, you must mention in the Payment details section of the payment order, the number of the order received by email, which represents the confirmation of the placed order.

X. Product description and return
Office Max makes every effort to be as accurate as possible. However, Office Max does not warrant that product descriptions or other related materials are accurate, complete, current or error-free. If a product offered by Office Max is different from its related description on the Site, you can return it in compliance with the provisions of the Site's Product Return Policy and in accordance with Romanian legislation in force.

The consumer has the right to notify the merchant in writing that he is canceling the purchase, without penalties and without citing a reason, within 10 working days from receiving the product or, in the case of services, from concluding the contract, in accordance with the provisions of Ordinance no. .130/2000.

If you agree to exercise this right, you have the following obligations:
- to return the purchased product, in the original, undamaged packaging, at your expense.
- to return the purchased product in working condition, undamaged, in the condition in which it was delivered.
The consumer cannot return the following purchased products, except in cases where the parties have agreed otherwise:
- extended warranty certificates;


XI. Reviews, comments, communications and other types of content
Users may post reviews, comments or other types of content; send suggestions, ideas, ask questions, propose articles or other types of materials, as long as their content is not illegal, obscene, threatening, defamatory, does not violate the right to privacy or the law regarding the protection of intellectual property; does not contain computer viruses, commercial, political communications, which incite hatred or intolerance on ethnic, religious, racial, sexual orientation grounds, collective messages or other forms of spam. In order to post reviews, comments, communications and other types of content, you may not use e-mail addresses or false identities. Office Max reserves the right, but does not have the obligation to remove or edit all types of content posted by users and does not have the obligation to review this content periodically. With the posting of reviews, comments, communications and other types of content on Office Max, you transfer, except in cases where the Company indicates otherwise, the intellectual property rights, in a non-exclusive, perpetual, irrevocable way, over the posted materials. The company has the right to modify, reproduce, transmit, adapt, publish, distribute the materials posted by users, through any means of mass communication, from any the country. By posting reviews, comments, communications and other types of content on Office Max, you give the Company the right to use your name in relation to the posted materials; guarantee that you own or otherwise control the intellectual property right over the materials you post; that the posted materials do not violate any of the conditions for posting reviews, comments, communications and other forms of content from users, of Office Max.
Office Max has the right, but not the obligation, to monitor, edit or delete any type of content or user activities on the Site. Office Max is not responsible and does not assume responsibility for any of the materials posted by other third parties on the Site. Office Max has the right not to publish all comments and articles proposed by users.

XII. Major force
Office Max, its affiliates and/and in general the suppliers of products or services to Office Max cannot be held responsible for any delay or error resulting directly or indirectly from causes beyond Office Max's control. This exemption includes, but is not limited to: errors in the operation of the technical equipment from Office Max, the failure of the Internet connection, the failure of telephone connections, computer viruses, unauthorized access to the Office Max systems, operating errors, as well as cases of force majeure stipulated by the Romanian legislation in force.

XIII. Advertising
Office Max can display, on its pages, advertisements for the products in its offer as well as for products or services belonging to third parties. By using Office Max and by accepting its Terms and Conditions of Use and the Privacy Policy, you directly express your consent to be the recipient of these commercial communications.

XIV. Complaints regarding the violation of the law regarding the protection of intellectual property
Office Max respects the intellectual property rights of third parties. If you have noticed that the Site contains information that infringes their right to intellectual property, please send us a notice to the email address or contact us at the phone number or mailing address shown in the About Us chapter of this contract.

XV. Applicable legislation
The services offered by the Company through Office Max are governed by the provisions of Romanian laws, especially Law 365/2002 on electronic commerce, Ordinance 130/2000 on consumer protection when concluding and executing distance contracts, HG 448/2005 and European Directive EC/ 96/2002, which regulates the tax regime for the green stamp, applicable to electronic products.
Office Max terms and conditions are subject to Romanian legislation. In case of litigation, an amicable solution will be tried first, within 30 working days from the registration of the complaint at the Office Max headquarters. In the event that an agreement cannot be reached within the previously specified term, the disputes between the Parties will be submitted to the resolution of the competent courts within the radius of the city of Bucharest.

XVI. Presentation of the offer
Office Max reserves the right to operate at any time, any changes to the prices and technical data present on the Office Max website, without prior notice. The technical data present on the Office Max website are informative and do not represent a contractual obligation. The photos on the Office Max website are informative and there may be differences between them and the product.
