Product Warranty Policy and Procedures

OFFICE MAX provides warranty services in accordance with applicable Romanian legislation, with the help of its own service units or authorized service units of partners or manufacturers, as appropriate. Clear details related to these warranties are provided by the product warranty certificates. Some products may have different warranty periods for certain components of the product (for example, a laptop battery warranty will be shorter than the laptop warranty).

Legal Entities

The warranty is included in the invoice or on a warranty certificate distinct from the invoice, depending on the specific procedures of each manufacturer. For warranty certificates issued by Office Max, the warranty period is a minimum of 3 months (parts, labor), and a maximum of 60 months for long-life products, as applicable. The deadline for bringing products into conformity is a maximum of 30 days. For warranty certificates issued by the manufacturer, the warranty conditions may vary depending on the manufacturer and are established in their commercial policies and in publicly available sources, at the clients' disposal.

Natural Persons

Products sold through OfficeMax benefit from the commercial warranty and the legal conformity warranty, according to G.E.O. no. 34/2014 and Law no. 449/2003.

The downtime due to non-conformity occurring within the warranty period extends the legal conformity warranty period and the commercial warranty period and runs, as appropriate, from the moment the seller was notified of the product's non-conformity or from the moment the product was presented to the seller/service unit until the product is brought into normal working condition and, respectively, written notification for product pickup or actual handover of the product to the consumer.

Long-life products that replace defective products within the warranty period will take over the warranty period of the original product plus the duration required for the product exchange/repair.

Long-life products that become defective within the legal conformity warranty period, when they cannot be repaired or when the cumulative downtime due to deficiencies occurring within the legal conformity warranty period exceeds 10% of the duration of this term, at the consumer's request, will be replaced by the seller or the seller will refund the consumer the equivalent value of the respective product.

The maximum resolution period is 15 calendar days from the date on which the buyer, as appropriate, notified the seller of the product's non-conformity and handed over the product to the seller or the person designated by the seller based on a handover-takeover document.

If the client claims non-conformity of the product and this is confirmed by OFFICE MAX, the Client has the right to request, as a remedial measure, primarily the repair of the product or the replacement of the product, in each case without charge, except where the measure is impossible or disproportionate.

A measure is considered disproportionate if it imposes unreasonable costs on OFFICE MAX compared to the other remedial measure, taking into account the value the products would have had if there had been no non-conformity, the importance of the non-conformity, or if the other remedial measure could be carried out without significant inconvenience to the Client.

The remedial measure will be ordered only if, after verifying the product whose non-conformity is invoked by the Client, OFFICE MAX ascertains that the defect exists and that the client's request is well-founded.

No warranty is provided for consumables. For example: batteries, accumulators, accessories, protective films, etc. However, the manufacturer's commercial warranty is transferred to the Client where and if available.

The product must be accompanied by:

  • The original Warranty Certificate issued by the manufacturer, for brands that issue such certificates.
  • The service acceptance form (FAS) number allocated after completing the Service Request.

Items Not Covered by Warranty:

  1. Defects and damages caused by improper storage, handling, damage, incorrect connection, or faulty operation and maintenance of the equipment by the beneficiary;
  2. Defects and damages caused by electrical, mechanical, chemical, or atmospheric factors that are outside the limits specified in the equipment's technical characteristics provided by the manufacturer and in the operating instructions;
  3. Use of the product in applications requiring performance and qualities other than those offered by the class and purpose for which this product is intended or outside technical specifications;
  4. Use of the product under unsuitable conditions (e.g., inadequate power supply voltage, non-existent or incorrect grounding, effects of shocks, vibrations, blows or other forms of physical abuse, use of the product in unsuitable environmental conditions – actions of chemicals, noxious substances, smoke, dust or humidity, product damage caused by bad weather or natural disasters);
  5. Connecting the equipment to an electrical network with frequent power supply interruptions or an inadequate power supply voltage;
  6. Connecting the equipment to makeshift outlets or multiple extensions;
  7. Intervention on the equipment by unauthorized persons of the seller or manufacturer;
  8. Breaking of seals, identification labels, or erasure of serial numbers;
  9. Defects and damages caused by force majeure, fortuitous event;

OFFICE MAX is not responsible for any incompatibilities that may arise between sub-assemblies supplied by the seller and products purchased by the beneficiary from other suppliers.

If there is a manufacturer-authorized service network within the national territory, the servicing conditions will be those stated by the manufacturer (e.g., Apple, HP, DELL, ...).

The product will be repaired or replaced if the conditions in the warranty certificate publicly declared by the manufacturer for Romania have been met, the client has followed the steps to report the service incident, and has followed the instructions received from Office Max service.

We do not assume the obligation to provide a warranty for products that have been sent for service via courier companies other than those agreed upon by Office Max and/or are not accompanied by the service acceptance form (FAS) received after the Service Request.

Office Max reserves the right not to be responsible for:

  • the duration of the service procedure and the condition of products delivered by courier companies other than those agreed upon;
  • products shipped without the FAS number written on the AWB;
  • products damaged during transport due to improper packaging, which implies packaging and protecting the product so that it reaches the service in the condition indicated in the service request initiated by the client.

ATTENTION! Products should only be sent for service if you have completed the Service Request form and received the FAS number (service acceptance form) in return.

You will receive the document representing the FAS within 10 working hours. Do not ship products without a FAS. 80% of reported service incidents are easily fixable without moving the product.

The product warranty is not transferable. Product serial numbers must match those delivered.

OFFICE MAX has a contractual obligation exclusively towards the holder of the purchase order (legal entity or natural person). In this regard, we will only accept warranty incidents from email addresses registered on orders placed on www.omax.ro and only for products delivered by us. This allows us to dedicate more time and improve our services for our customers and to combat unfortunate events specific to the current online environment.

If you have a commercial contract with other warranty conditions with us (SICAP, corporate), it prevails over these warranty conditions.
